Welcome to shoprefashion.com! We are big on making the world a better place for all. We believe that everyone should REUSE, RECYCLE, AND REFASHION! Therefore, our agreement includes THE GREEN PLEDGE. Before you may register to become a member and access the services offered by Refashion, LLC ("we" or "Refashion") on our website shoprefashion.com (the "Site"), you must read and accept all of the General Terms and Conditions and other policies below, as amended from time to time (collectively, the "Agreement"). This Agreement is immediately effective for all members on January 30, 2010, and upon acceptance by new members. GREEN PLEDGE TERMS OF SERVICE
This agreement is made with Refashion, LLC a South Carolina, USA Limited Liability Company, Owner and operator of this Site. This Site is intended to be a friendly, enjoyable and useful experience, but as with anything concerning any kind of transactions there are risks involved and we strongly advise you to understand all of these terms before joining. REPRESENTATION
By using our services you represent to us that you are: (a) 18 years of age, not a minor under applicable laws and you have the authority to form legal contracts; (b) you have legal title to and ownership of the products and the content (including all intellectual property rights) that you sell on our website; and (c) the information you have provided us during the registration process and thereafter, including all information relating to your items for sale, whether or not posted on the Site, is to the best of your knowledge complete, truthful and accurate. Membership to this Site is only available to those who can form a legally binding contract. This Site does not permit minors (under 18) to register. If any member fails to signup with their correct age the account will be terminated immediately. Refashion, LLC reserves the right to verify all information and may at our discretion cancel or refuse any membership. RIGHTS TO SUSPEND OR TERMINATE
You agree that this Site, at its own discretion, may terminate any auction or use of the service immediately and without notice if (a) We believe that you are not abiding by the general rules of this web-site (b) You have repeatedly broken a certain term (c) You have listed a suspicious item (d) We believe you to be a non paying bidder. In most cases when we suspect foul play we will suspend your account/listing whilst we investigate further. If our investigation is conclusive then your account with us will be terminated. FEES
FIRST 10 ITEMS ARE FREE (NON-STORE MEMBERS ONLY). All members are on an escalating fee scale. You will be invoiced the due amount according to the number of listings per month. Payment is due within 5 days of billing date. Unpaid invoices are subject to suspension of your account/store and ability to use our services. Three warnings of unpaid invoices at any time will result in termination of your membership/account/store. Whether you open a store or not, the fees below are the same based on quantity. Opening a store though may enhance your marketing efforts. Stores will be charged a montly recurring flat rate of the applicable amount below. There are no insertion fees, final value fees or hidden charges; fees are based per month (30-day period) from the 1st to the 30th.

TAX
It is the responsibility of the Seller to charge the applicable tax if any. Refashion, LLC is only a tool in which buyer and seller will transact their business. VERIFY INFORMATION
All members must provide accurate information for Refashion, LLC to contact and verify. If we cannot verify your information or your information is deemed inaccurate, whether individually or as a business it will result in termination or suspension of your account.
FAIR DEALINGS
If you spot a listing that you feel is violating the general terms and conditions of this Site as stated herein please let us know by contacting us. Because we are an auction site open to the public, we cannot control what photos members upload and cannot verify the information of the contents listed for sale to be in fact truthful, nor can we verify if a person can or cannot pay for the item(s) they purchased; therefore you will not hold Refashion, LLC responsible for any transaction or content on its site. We do believe in fair dealings and will do our best to ensure that your transactions are safe and happy and that you are fully satisfied with your transactions. Most items will be in used condition and we encourage sellers to include as much information of the product's condition as well as a photo(s) for the buyer inspection. Because we cannot guarantee a product's condition or make any warranty on any sold products we urge Buyers to please inspect the photos carefully and ask the seller questions that may concern you. We will do our best to keep fraudulent sellers off of our website; however we cannot guarantee that our efforts are effective. Therefore, “Stores” must use a verifiable name, and allow us to check periodically your real identity by requesting for verification as may be reasonable and appropriate, at our sole discretion. We expect all members to honor the terms of sale; refrain from any unruly, disruptive, unprofessional, or offensive conduct while using our Site and while communicating with other members or employees of Refashion, LLC. All communication between members and employees of Refashion, LLC must be civil. CONDUCT You are solely responsible for the contents of your actions through this Site. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you are entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation. You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law or regulation. You may not harass or interfere with the privacy of any Buyer or Seller, and post false, inaccurate, misleading, defamatory, or libelous content about any Buyer, Seller, or Refashion, LLC. TRANSFER OF OWNERSHP Sellers must disclose any transfer of ownership needed for the products listed and sold on our website. We do not handle any transfers of legal ownership. Buyers must ask Sellers if not discussed prior to close of the transaction. RELEASE OF ALL LIABILITY Let us know if you have any concern about a transaction. Although we will do our best to ensure you have a safe and secure experience on our Site, we cannot guarantee your transaction is secure nor can we guarantee access to our Site due to interference beyond our control. Accordingly, to the extent legally permitted, we exclude all implied warranties, terms and conditions. We are not liable for any loss of money, direct or indirect or consequential damages arising, directly or indirectly, out of your use of our Site. If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures, and employees) from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor." This Site acts as the window for sellers to conduct auctions and for bidders to bid on sellers' auctions. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on. In addition, note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretense. This Site shall not be responsible for any items sold by Auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. This Site shall not be responsible for the cost of procurement of substitute goods or any losses resulting from any goods purchased or obtained. This Site assumes no liability for the content of the listings. However if you fall victim of a fraudulent transaction we will assist you as much as we can. If we are found to be liable, our liability to you or to any third party is limited to the fees you paid to us in the 3 months prior to the action giving rise to the liability, and $10. These Terms of Service shall be governed by and constructed in accordance with the laws of the State of South Carolina in the Unites States of America and any disputes will be decided only by the Courts of the United States of America. Sellers are not permitted to sale pornographic material or items that are not able to be mailed (i.e. flammable liquids, explosives) or alcohol beverages without the proper Government authorization and approval. SUBJECT TO CHANGE
